OrangeBall Creative, Inc. (“OrangeBall.ai,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your information. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use OrangeBall.ai.
This Privacy Policy applies to information collected through OrangeBall.ai and related services that link to this policy (the “Services”). This policy does not apply to third-party websites, services, or applications that may be accessible through the Services but do not link to this policy.
For purposes of this Privacy Policy, “Personal Data” means information that identifies, relates to, or could reasonably be linked to an identifiable individual.

We may collect information you provide directly, including:
- account information (name, email, login credentials);
- business information (company name, role);
- Customer Input (as defined in the Terms of Service), including marketing content, prompts, brand messaging, or other materials you submit through the Services.
You may not submit Sensitive Data (as defined in our Terms of Service) through the Services. See the Prohibited Data section below. When you upload or process Personal Data about other individuals through the Services (such as customer contact information), you are responsible for ensuring that you have the legal right and appropriate permissions to provide that data. OrangeBall.ai processes that information on your behalf solely to provide the Services.
b. Automatically Collected Information
We may collect:
- device and browser information;
- IP address and general location;
- usage data and interactions with the platform.
We may also collect technical information about how users interact with the Services, such as pages viewed, session activity, and general usage patterns.
c. Cookies and Tracking Technologies
We use cookies and similar tracking technologies to:
- operate and improve the platform;
- analyze usage;
- support marketing and conversion tracking.
Cookies may include functional cookies necessary to operate the platform and analytics cookies used to understand how users interact with the Services.
You can control cookies through your browser settings. We do not currently respond to “Do Not Track” browser signals. Some browsers and extensions support the Global Privacy Control (“GPC”) signal. When we detect a GPC signal, we will make reasonable efforts to honor your opt-out preferences as required by applicable law.
2. How We Use Information
We use information to operate the Services, provide the features you request, improve the platform, communicate with users, and comply with legal obligations.
We use information to:
- provide, operate, and maintain OrangeBall.ai;
- generate AI outputs;
- improve and enhance the platform;
- monitor usage and prevent fraud or misuse;
- communicate with you;
- comply with legal obligations.
We may also use aggregated or de-identified information to analyze platform performance, improve features, and develop new functionality.
3. AI Processing and Third-Party Providers
OrangeBall.ai relies on third-party providers to deliver the Services, including:
- Artificial intelligence providers (e.g., OpenAI) for generating outputs;
- Cloud infrastructure providers (e.g., Supabase or similar providers) for data storage and processing; and
- Third-party payment processors for payment handling. OrangeBall.ai does not store full credit card numbers.
These providers process data on our behalf to operate the Services.
Customer Input may be transmitted to these providers for the purpose of generating AI outputs and operating the Services. We may use technical measures designed to reduce identifiable information before transmitting data to third-party providers, but such measures may not eliminate all identifiable information in all cases. AI-generated outputs may contain information derived from Customer Input and may be stored, processed, and displayed as part of providing the Services.
We may identify significant third-party service providers through the Services or on our website. Such providers may change from time to time as we update or improve the Services. OrangeBall.ai does not control third-party systems or how third-party providers collect or use information through their own technologies, and you are encouraged to review their respective privacy policies.
4. Use of Data
We may use data to improve the Services and develop new features; however:
- We use only aggregated, anonymized, or de-identified data for training, analysis, and improvement;
- We do not use identifiable Personal Data to train models; and
- We do not share identifiable Personal Data with other users.
We may use or disclose information as necessary to enforce our Terms of Service and other agreements. Aggregated or de-identified information may also be used for analytics, research, benchmarking, and other business purposes that do not identify any individual.
5. Data Sharing and Disclosure
We do not sell or share your Personal Data for monetary consideration or for cross-context behavioral advertising.
We may share information in the following situations:
- service providers that help operate the Services (such as hosting providers, analytics providers, artificial intelligence providers, and payment processors) who process information on our behalf;
- to comply with legal obligations;
- to protect rights, safety, and security;
- in connection with a business transfer (e.g., merger or acquisition).
We may disclose information if required by law, court order, or governmental request. We may also disclose information if we have a good faith belief that disclosure is necessary to enforce our agreements, including our Terms of Service, detect, investigate, or prevent violations of those terms, or protect the rights, property, or safety of OrangeBall.ai, our users, or others. Aggregated or de-identified information that does not identify any individual may be disclosed without restriction.
6. Data Retention
We retain information as long as necessary to:
- provide the Services;
- comply with legal obligations; and
- resolve disputes and enforce agreements.
We may retain:
- anonymized or aggregated data indefinitely;
- certain information after account termination for legal, security, or compliance purposes.
When determining retention periods, we consider the nature of the information, legal obligations, operational needs, and potential risks associated with retaining the data. After account termination, we may delete or de-identify information unless retention is required for legal, security, fraud prevention, or operational purposes. At the end of any applicable retention period, Personal Data will be deleted, destroyed, or de-identified so it can no longer be linked to you. Data retained in anonymized or aggregated form is no longer Personal Data and is not subject to individual deletion requests.
You may request deletion of your data at any time, subject to legal and operational limitations.
7. Your Rights
Depending on your state of residence and applicable law, you may have the right to:
(a) access a copy of the Personal Data we hold about you;
(b) request correction of inaccurate Personal Data;
(c) request deletion of your Personal Data, subject to legal and operational limitations;
(d) opt out of the use of your Personal Data for targeted advertising or profiling; and
(e) receive your Personal Data in a portable format where technically feasible.

- Prohibited Data
You may not submit Sensitive Data (as defined in our Terms of Service), including, but not limited to:
- health or medical information;
- financial account or payment information;
- government identification numbers; and,
- biometric data.
These restrictions correspond to the Sensitive Data limitations described in the Terms of Service.
9. Data Security
We implement commercially reasonable administrative, technical, and organizational measures designed to protect your information. However, no website, platform, or data transmission system can be guaranteed to be completely secure, and you use the Services at your own risk.
You are responsible for maintaining the confidentiality of your account credentials and for protecting access to your account. You should carefully consider what information you submit through the Services, including in prompts, content, or communications.
10. International Users
OrangeBall.ai operates in the United States. By using the Services, you consent to the transfer and processing of your data in the United States and other jurisdictions where our providers operate.
Data may also be processed and stored by third-party service providers on our behalf in jurisdictions where those providers operate, which may include locations outside your state or country.
11. Children’s Privacy
The Services are not intended for individuals under 18. We do not knowingly collect data from children. If we learn that we have collected Personal Data from a child under 18, we will delete that information.
12. Changes to This Policy
We may update this Privacy Policy periodically. If we make material changes to how we collect, use, or share your Personal Data, we will provide at least 30 days’ notice through the Services or by email before those changes take effect.
For non-material changes, your continued use of the Services after the updated policy is posted constitutes your acceptance. Material changes take effect 30 days after notice as described above.
